EMPLOYMENT IN MONACO (Getting a Job)

Public Sector

The recruitment of personnel by the Monegasque Civil Service is the object of either Ministerial Orders, which announce the opening of entrance examinations, or Notices of recruitment, which specify the nature and characteristics of the positions to be filled as well as the conditions that the candidates must satisfy.

These Orders and Notices are published in full in the "Journal de Monaco", the Principality’s official weekly bulletin, published on Fridays. The Orders are also displayed on the door of the Ministry of State, Place de la Visitation in Monaco-Ville and accessible online on the government website ( www.gouv.mc ).

Once made aware of a potentially suitable vacancy, through the channels mentioned above and not in any spontaneous way, it is up to candidates to submit an application for the position should they satisfy the conditions required.

Candidates should be aware, however, that Monegasques have priority with regard to the positions advertised.

The main documents that must accompany an application are the following :

· A request on plain, unheaded paper or stamped paper, depending on the case, accompanied by an identity photograph ;
· A birth certificate or photocopy of the Livret de Famille (official family record book) ;
· Copy of police record dated less than three months earlier (1) ;
· A certificate of nationality (for persons of Monegasque nationality) ;
· A certified copy of any diploma(s) obtained ;
· A copy of the supporting documents for the references presented ;
· A duly completed information sheet, available from the ‘Direction de la Fonction Publique et des Ressources Humaines’ (Civil Service and Human Resources Department) or accessible online on the government website under the heading " forms ".

Private Sector

No foreigner can occupy a salaried position in Monaco without a work permit, and any change of employer or job description necessitates a new permit.

The employer who wishes to employ or re-employ an employee of foreign nationality must first obtain written permission before the employee can take up his post.

Permission can be refused if job seekers with priority in the eyes of Monegasque law have the same qualifications.

To register as a job seeker, an identity card with an up-to-date address or a valid residence permit must be presented.

The order of priority is as follows :

- Persons of Monegasque nationality
- Foreigners married to a Monegasque and not legally separated, and foreigners born to a Monegasque parent
- Foreigners living in Monaco and having already worked there
- Foreigners living in the surrounding area and authorised to work there.

These priorities aim to protect the local workforce.

In order to apply them, employers are required to declare any job vacancies to the Employment Service, who, within four days, will send them candidates for the position.

In the absence of a candidate who has priority, the employer can propose an applicant.

The applicant must have :

- if resident in the Principality, a valid Monegasque residence permit ;
- if resident in France, a French identity card or a valid residence permit that authorises him to work ;
- should he live neither in Monaco, or France, the applicant must conform to the regulations concerning the entry of foreigners.

In the latter case, the employer must draw up contract of employment for a foreign worker. Following approval from the Employment Service, this contract will enable the visa required for entry into the Principality (for those outside the European Union) to be obtained from the consular authorities of the employee’s country of origin.

Comments :

1. The steps are simplified for French managers on assignment.

2. Employers of their own household staff are not subject to the official procedure for hiring employees. They are simply required to provide a photocopy of the residence permit with the employer’s address and phone number.

3. Foreigners need a letter of appointment, in the form of an undertaking of employment stamped by the Employment Service, in order to obtain a residence permit issued by the Department of Public Safety.

4. For employees that are unknown in the Principality or who have stopped working for a period of 6 months, the agreement of the Department of Public Safety as well as the Occupational Health Office are necessary to obtain a work permit.
