Hi,

if anyone knows how to sort out my problem, two newly weds will be deeply grateful for your input and time.

In a nutshell, I misunderstood that a second visit on a multiple entry visa would only allow me to stay the unused portion of my earlier visit within the same year.

In late Nov. when I went for an extension on my second visit, with a marriage pending in Brazil, I found out I had overstayed by 8 days. I paid the fine and left the country, with the understanding that I had to stay out for six months before I could return.

My fiance was pretty put out by this news and made some enquiries with the Federal Police. She was told that if we were to marry in the USA, I could apply for permanent residency and the earlier infraction would not be an issue now that I'm married to a Brazilian national.

So she joined me in the US and we got married. Now the LA Consulate informs us that I am not eligible to return to Brasil for 1 calendar year, because of the overstay.

This news was a blow to both of us on so many levels. I'm hoping that someone who reads this can advise me how to resolve this in a cost effective and timely fashion. I've given the gist and will be happy to answer any questions for further clarification.

Can anyone comment on this post? I am going to be in a similar position.

I assumed that the 90 days plus 90 days extension were on a calendar year basis. Then I did not notice that on my second visit here that my visa was only for 61 days. After nearly 90 days I applied for an extension and was told that I had overstayed my visa. They gave me a 90 day extension and said that I would be fined R$8 per day on my departure and I am ready to pay that.

It was a nasty shock to read about a one year exclusion due to the infraction. As a UK passport holder I do not need a visa before arrival. It would be awful to arrive in SP next year and be turned away.

Can I sort this out before leaving Brazil? There is no international airport around here.
